Don't use FlamingText for illegal, hateful, threatening or abusive content. Don't scrape or bulk-download our content, abuse the service, or use FlamingText content to train AI or machine-learning systems without our permission.

If you buy a Commercial Licence, it's perpetual and royalty-free. Your logo isn't guaranteed to be unique, and you're responsible for making sure you have the rights to any names, trademarks, images or other material you use.

Welcome to the websites and services of FlamingText.com Pty Ltd ("FlamingText", "we", "us" or "our"). These Terms of Use ("Terms") govern your access to and use of flamingtext.com, its subdomains, and other websites and online services owned and operated by FlamingText (collectively, the "Website").

By accessing or using the Website, you agree to these Terms. If you do not agree to these Terms, you must not use the Website.

1. Generated Graphics and FlamingText Content

FlamingText allows users to create logos, text effects and other graphics ("Generated Graphics") using styles, templates, fonts, effects, software and other materials made available through the Website.

Unless otherwise stated, the Website, its software, templates, styles, designs, effects, interfaces and other FlamingText content are owned by or licensed to FlamingText and are protected by copyright and other intellectual property laws.

Creating or purchasing a Generated Graphic does not transfer ownership of the underlying FlamingText software, templates, styles, effects or other materials used to create it.

Other users may create Generated Graphics that are identical or similar to yours. FlamingText does not guarantee that any Generated Graphic is unique or exclusive.

2. Personal and Academic Use

Subject to these Terms, FlamingText grants you a non-exclusive, non-transferable licence to download and use Generated Graphics for personal and academic, non-commercial purposes.

Examples include personal emails, personal websites and blogs, school or university projects, invitations and other non-commercial projects.

Unless you purchase a Commercial Licence, you must not use Generated Graphics for commercial purposes.

You may host a Generated Graphic yourself. If you do, we appreciate, but do not require, a link to FlamingText.

3. Commercial Use

A Commercial Licence is available for purchase for Generated Graphics.

When you purchase a Commercial Licence, FlamingText grants you a perpetual, royalty-free, non-exclusive licence to use the licensed Generated Graphic for personal or commercial purposes, subject to these Terms and any third-party rights or licence terms that apply to material incorporated into the Generated Graphic.

Commercial uses may include websites, advertising, T-shirts and other merchandise, band artwork, videos, posters, games, apps, newsletters, social media, printed material and artwork produced for customers.

You may incorporate a commercially licensed Generated Graphic into work that you sell or supply to a customer.

You may provide a commercially licensed Generated Graphic to a customer as part of work you create for that customer, and the customer may continue to use the Generated Graphic as part of that work.

A Commercial Licence relates to the Generated Graphic and does not transfer ownership of FlamingText's underlying templates, styles, effects, software, fonts or other materials.

A Commercial Licence is non-exclusive. Other users may create or use identical or similar Generated Graphics.

Survival of Commercial Licences

Once validly purchased, a perpetual Commercial Licence continues even if:

  • you stop using the Website;
  • your account is closed;
  • FlamingText changes or discontinues the Website or a feature of the Website; or
  • these Terms are subsequently changed.

A Commercial Licence may be revoked if it was obtained through fraud, an unauthorised or reversed payment, or other unlawful means. If the purchase price for a Commercial Licence is refunded, the Commercial Licence ends and you must cease commercial use of the applicable Generated Graphic, unless we expressly agree otherwise.

4. Your Content

You may provide text, images, photographs, fonts or other material to FlamingText in connection with creating a Generated Graphic or using the Website ("User Content").

You retain any rights you already hold in your User Content.

You grant FlamingText a non-exclusive, worldwide licence to host, copy, process, modify and otherwise use your User Content only as reasonably necessary to provide, operate, maintain and improve the Website and the services you request.

You represent that you have the rights and permissions necessary to provide your User Content to FlamingText and to permit us to process it for these purposes.

You must not submit User Content or use the Website in a manner that infringes another person's copyright, trademark, privacy, publicity or other legal rights.

5. Trademarks, Copyright and Uniqueness

FlamingText is a graphic creation service. We do not provide legal advice and do not perform trademark, copyright or other intellectual property clearance searches.

A Personal, Academic or Commercial Licence from FlamingText does not mean that:

  • a word, business name, logo or design is available for use or registration as a trademark;
  • a Generated Graphic is unique;
  • you own exclusive rights to a Generated Graphic;
  • a Generated Graphic does not resemble a design or trademark used by somebody else; or
  • you have rights to names, trademarks, photographs, fonts, artwork or other third-party material that may appear in a Generated Graphic.

You are responsible for determining whether your intended use of a Generated Graphic is lawful and whether any additional permissions or licences are required.

If a Generated Graphic is important to a business or brand, you should consider obtaining appropriate professional advice and conducting relevant trademark searches before relying on it.

6. Third-Party Material

Some fonts, clipart, photographs, stickers, shapes or other material available through the Website may originate from or be licensed by third parties.

Where third-party material is subject to separate licence terms, those terms continue to apply.

FlamingText cannot grant you rights that it does not itself possess. You are responsible for complying with any applicable third-party licence conditions.

The ability to render text using a font through FlamingText does not grant you ownership of, or a licence to redistribute, the underlying font software.

FlamingText does not own the brand or product logos depicted or referenced on the Website and does not grant rights to those brands or trademarks. Brand names, product names, logos and trademarks remain the property of their respective owners.

Their appearance on the Website does not imply endorsement, sponsorship or affiliation with FlamingText.

7. FlamingText Image Hosting

FlamingText may provide free hosting of Generated Graphics, sometimes referred to as "hot-linking".

If you use FlamingText's free image hosting service, we require a visible link to FlamingText on each page containing an image hosted by us.

If the required link is not present, we may add a FlamingText watermark or notice to the hosted image, replace the image, restrict hot-linking, or stop hosting the image.

Free image hosting is provided as a convenience. We do not guarantee its availability, performance or continued operation and may limit or discontinue free image hosting at any time.

If an image is important to you or your business, you should store and host your own copy.

8. Restrictions

You must not:

  • use the Website or Generated Graphics to promote hatred or violence against a person or group, or in a way that is unlawful, fraudulent, defamatory, threatening, harassing or otherwise violates the legal rights of another person;
  • use the Website to create or distribute material where doing so would itself be unlawful;
  • infringe another person's copyright, trademark, privacy or other rights;
  • use automated means to scrape, harvest, bulk-download or systematically extract Generated Graphics, Website content or other data from FlamingText without our written permission;
  • use automated systems to generate Generated Graphics in bulk except through an API or other automated service expressly authorised by FlamingText;
  • circumvent rate limits, usage limits, access restrictions, security controls or other technical measures;
  • use multiple accounts, addresses or other methods to evade restrictions imposed by FlamingText;
  • interfere with, overload, disrupt or attempt to gain unauthorised access to the Website, its servers, networks or other systems;
  • probe or test the security of the Website without our permission;
  • decompile, reverse engineer or otherwise attempt to derive source code from FlamingText software except where applicable law expressly permits it;
  • remove copyright, trademark or other proprietary notices;
  • mirror or reproduce substantial portions of the Website on another server or service;
  • resell access to the Website or provide an unauthorised service based upon FlamingText's Website or infrastructure; or
  • build or distribute a collection or library consisting substantially of Generated Graphics, FlamingText templates, styles or derivatives of them without our written permission.

9. Artificial Intelligence and Machine Learning

Unless you have FlamingText's prior written permission, you must not use the Website, Generated Graphics, templates, styles, effects, metadata, datasets or other FlamingText content to train, fine-tune, develop, evaluate or improve an artificial intelligence, machine learning or similar system.

You must not scrape, collect or systematically generate material from FlamingText for the purpose of creating or contributing to a dataset for such a system.

Commercial arrangements for AI or machine-learning use may be available. Please contact us if you are interested.

10. Accounts and Security

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account.

You must provide reasonably accurate information and must not impersonate another person or use an account without authorisation.

Please notify us if you believe your account has been compromised.

We may suspend or restrict an account where reasonably necessary to protect FlamingText, our users or third parties, investigate suspected misuse, prevent fraud or security problems, or enforce these Terms.

11. Payments and Refunds

Prices, currencies and applicable taxes will be displayed at or before purchase.

A Commercial Licence becomes effective when the applicable payment has been successfully completed and remains in effect unless the payment is refunded, reversed or otherwise cancelled. If the payment is refunded, reversed or cancelled, the Commercial Licence ends and you must cease commercial use of the applicable Generated Graphic, unless we expressly agree otherwise.

We may cancel or suspend a transaction affected by fraud, an unauthorised payment, a chargeback or a material payment error.

Any refund policy we publish forms part of these Terms.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified, including rights that may apply under the Australian Consumer Law.

12. Intellectual Property Complaints

We respect intellectual property rights.

If you believe material available through FlamingText infringes your copyright, please see our Copyright Infringement Notification Procedure.

For trademark or other intellectual property complaints, please contact us and provide sufficient information for us to identify the material and understand your claim.

We may remove or restrict access to material while we investigate a complaint and may take appropriate action in relation to users who repeatedly infringe the rights of others.

13. Availability and Changes to the Service

We continually change and improve FlamingText.

We may add, modify or discontinue features, templates, styles, formats, storage, hosting or other aspects of the Website.

We may also impose reasonable limits on use of free or paid services where necessary for security, reliability, capacity or abuse prevention.

We do not guarantee that the Website or any particular feature will always be available or operate without interruption or error.

Where a change materially affects a paid service, we will comply with any rights and obligations that cannot lawfully be excluded.

14. Termination and Suspension

You may stop using the Website at any time.

We may suspend or terminate your access to the Website if you materially breach these Terms, misuse the Website, fail to pay amounts properly due, create security or legal risk, or where suspension or termination is otherwise reasonably necessary to protect FlamingText, its users or third parties.

We may also discontinue all or part of the Website.

Termination of access to the Website does not terminate a validly purchased perpetual Commercial Licence except as expressly provided in Section 3.

Provisions which by their nature are intended to continue after termination, including intellectual property provisions, licence restrictions, disclaimers and limitations of liability, continue to apply.

15. Disclaimer

The Website and free services are provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, FlamingText does not warrant that the Website will be uninterrupted, error-free, secure or suitable for every particular purpose, or that information or materials available through the Website will always be accurate, complete or current.

FlamingText may correct errors or change Website materials at any time but does not undertake to update every item of information.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.

16. Limitation of Liability

To the maximum extent permitted by law, FlamingText's total aggregate liability arising out of or relating to the Website, a Generated Graphic or these Terms will not exceed the amount you paid FlamingText for the applicable service during the 12 months preceding the event giving rise to the claim.

This limitation does not apply to liability that cannot lawfully be excluded or limited.

To the extent that FlamingText is entitled by law to limit its liability for a failure to comply with a statutory guarantee, its liability will be limited in the manner permitted by applicable law.

17. Your Responsibility for Claims

You are responsible for claims, losses or expenses reasonably incurred by FlamingText as a result of a third-party claim arising directly from:

  • User Content that you supplied;
  • your infringement of another person's intellectual property or other legal rights;
  • your unlawful use of the Website or a Generated Graphic; or
  • your material breach of these Terms.

This does not apply to the extent that the claim, loss or expense was caused or contributed to by FlamingText.

18. Privacy

Our collection and handling of personal information is described in our Privacy Policy.

By using the Website, you acknowledge that your personal information will be handled in accordance with that policy and applicable privacy law.

19. Third-Party Websites and Services

The Website may contain links to websites and services operated by third parties.

FlamingText does not control those services and is not responsible for their content, availability or practices.

A link does not necessarily indicate that FlamingText endorses or is affiliated with the third-party service.

Your use of third-party websites and services is subject to their own terms and policies.

20. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Website, our business, technology, legal requirements or other circumstances.

The current Terms and their effective date will be published on the Website.

Changes will generally apply to your use of the Website after the updated Terms take effect.

Changes to these Terms will not retrospectively remove or materially reduce rights granted under a Commercial Licence purchased before those changes took effect.

Where required by law, we will provide appropriate notice of material changes.

21. Force Majeure

To the extent permitted by law, FlamingText is not responsible for a delay or failure to perform an obligation caused by circumstances outside its reasonable control, including failures of telecommunications networks, hosting providers or other infrastructure, natural disasters, governmental actions, widespread internet disruption, cyberattacks or similar events.

22. General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.

If FlamingText does not immediately enforce a provision of these Terms, that does not mean we waive our right to enforce it later.

You may not assign your rights or obligations under these Terms except with our written consent. FlamingText may assign these Terms in connection with a sale, transfer or reorganisation of its business or assets, subject to applicable law.

These Terms, together with our Privacy Policy and any additional terms expressly applicable to a purchase or service, constitute the agreement between you and FlamingText concerning your use of the Website.

23. Governing Law

These Terms are governed by the laws of Queensland, Australia, without regard to conflict-of-law principles.

Subject to any rights you may have under applicable consumer law, the courts of Queensland, Australia will have jurisdiction in relation to disputes arising from these Terms.
